These Terms and Conditions apply to the sale of any Course. Please read these Terms and Conditions carefully before purchasing a Course and print off a copy for your records. By ordering a Course you are confirming your agreement to be bound by these Terms and Conditions.

DT may need to update these Terms from time to time. Any changes will be immediately effective.

 

1. Definitions

“Additional charges” means any amounts payable which are not Fees and may include, but are not limited to, payment of the delivery of extra Study Materials;

“Brochure” means any online or hard copy document that is produced by DT to provide detailed information with respect to the Courses these Terms cover;

“Classroom Course” means a classroom based course and the Study Materials to be provided by DT;

“Commencement Date” is the contracted date when the payment starts;

“Completion Date” is the contracted date when the payment must be finalized;

“DT” means Dutch Teacher – Leraar Nederlands voor Anderstaligen;

“Enrolment Form” means form that can be found on this website to enrol in one of our courses;

“Exam” means a test not organized by DT, but by third parties such as, but not limited to, embassies;

“Extra Services” are services provided by DT, different than Courses, such as, but not limited to, assisting students in finding accommodation and airport service;

“Fee” means the fee payable for the Course and/or Study Materials, but excludes Additional Charges or Extra Services;

“Instalment Plan" means the set period and dates over which payment will be charged;

“One-on-One Course” means a course with only one student;

“Online Course” means a course by Skype and/or Study Materials online to be provided by DT;

“Session” means any lesson session which can take 1 hour or 2 or more successive hours;

“Student(s)” means the individual attending the Course;

“Study Materials” means, but is not limited to, Syllabus or Online Learning Materials and Audio Materials;

“Termination” means stopping or leaving all or part of the Course or Courses booked, once the first course has started.

“Terms” means these Terms and Conditions.

“Website” means this website; and

“You” means the individual purchasing the Course and the Student.

 

2. Conditions of Enrolment

2.1 Application

2.1.1 Please fill in the Enrolment Form on the Website. Your privacy is important to us. Please note that by submitting your personal data to us, you are accepting the Terms described in our Privacy Policy.

2.1.2 Before sending you must have read and agree with these Terms and Conditions.

2.1.3 The enrolment is realized by sending the online Enrolment Form. Upon acknowledgement of course confirmation you enter a contract directly with DT.

2.1.4.1 For the Classroom Courses at least € 100 as part of the Fee will be made to the school within three days after course confirmation by DT.  This € 100 is considered as Administration Costs. Administration Costs are not refundable.

2.1.4.2 For the One-on-One Courses you can choose either (a) a package or (b) pay by session.

(a) For a package at least € 100 as part of the Fee will be made to the school within three days after sending the enrolment form.  This € 100 as part of the Fee is considered as Administration Costs. Administration Costs are not refundable.

(b) If you pay by session, then always 2 sessions should be paid in advance. This means that on the first session at least 3 sessions must be paid.

2.1.4.3 For the Online Courses the payment of your order must be done completely by Paypal and immediately after filling up the Enrolment Form. In this payment are the Administration Costs of the amount of €100 included. Administration Costs are not refundable. After you receive your personal login with password there is no any refund possible.

 

3. Payment Terms

3.1 The Fee for any Course at any given time will be displayed on the Website.

3.1.1 Currency conversions are based on the daily exchange rate and will fluctuate with the daily variations in the exchange rate. For the pre-payments the exchange rate of the day will be applied.

3.1.2 DT has the right to change prices due to tax increases or other events beyond DT’s control.

3.1.3 Tuition fees include lessons, progress testing and a certificate on completion of the course. DT reserves the right to withhold the granting of a certificate attained by a student if Tuition Fees or any other Fees remain outstanding, or other conditions are not met.

3.1.4 Any additional services (transfers, travel, telephone costs, excursions, medical costs, exam fees and enrolment amendments) are not included in any fees unless specifically stated.

3.2 In the unlikely event that due to a technical error, the amount of the Fee displayed on the Website or in the Brochure is incorrect, or the Fee has been changed on the Website but the Brochure is out of date, DT will notify you as soon as it reasonably can. If the correct amount of the Fee is higher than the amount displayed on the Website and/or in the Brochure, DT will contact you to notify you of the correct Fee, so you can decide whether or not you wish to continue with your order of the Course at the increased Fee.

3.3.1 Payment Classroom Courses

3.3.1.1 For the Classroom Courses no Study Materials will be made available, unless DT has received at least € 100 as part of the total payment from you.

3.3.1.2 You will not be allowed to start your Classroom Course unless DT has received at least 1/3 of the Fee from you.

3.3.1.3 DT has the Instalment Plan option for those who wish to manage their budget by paying the tuition fee in instalments over a period. The  Instalment Plan will be discussed between you and DT. If payments are too late according to the agreed Instalment Plan, the student will not be allowed in the rest of the Course. All instalments must be finalized at least two class weeks before the end of the Classroom Course. Under these Terms and Conditions, this date is known as the ‘Completion Date’ and the period between Commencement Date and Completion Date is referred to as the ‘Payment Period’.

3.3.2 Payment One-on-One Courses

3.3.2.1 If you buy a package, DT has the Instalment Plan option for those who wish to manage their budget by paying the tuition fee in instalments over a period. The  Instalment Plan will be discussed between you and DT. If payments are too late according to the agreed Instalment Plan, the student will not be allowed in the rest of the Course. All instalments must be finalized on the date that 75% of the purchased package has been consumed. Under these Terms and Conditions, this date is known as the ‘Completion Date’ and the period between Commencement Date and Completion Date is referred to as the ‘Payment Period’.

3.3.2.2 If you pay by session, then always 2 sessions must be paid in advance. Advanced payments will be used to pay for those sessions when you were too late to or didn’t inform DT about your absence for the scheduled session. You must always inform DT about a cancellation of a session by e-mail, at least 24 hours before a scheduled session on a working day (from Monday to Friday) and at least 48 hours before a scheduled weekend session or a session on a public holiday.  If you fail to do that, the lesson will be charged as given.

3.3.3 Payment Online Courses

3.3.3.1 You can purchase Online Courses by level. Every level will give you access to a number of online learning materials on our website combined with a number of Skype hours with the teacher. You get only a login with password after receiving your complete payment for the ordered level.

3.3.3.2 If you pay by online session, then always 2 online sessions must be paid in advance. Advanced payments will be used to pay for those sessions when you were too late to or didn’t inform DT about your absence for the scheduled session. You must always inform DT about a cancellation of a session by e-mail, at least 24 hours before a scheduled session on a working day (from Monday to Friday) and at least 48 hours before a scheduled weekend session or a session on a public holiday. If you fail to do that, the lesson will be charged as given.

3.4 Special Offers

Special Offers must be booked and paid for prior to the stated expiration date. Promotion prices apply to new enrolments only. Existing enrolments cannot be cancelled and rebooked at the promotion price. Only one offer is valid per enrolment. Special offers cannot be combined. All special offers are subject to availability and subject to change.

 

4. Cancellation Rights, Refund and Deferral Policy

4.1 You may cancel your purchase of a Course:

(a) within a period of 14 calendar days (“Cancellation Period”) from the date on which the contract is concluded subject to Clause 4.1(b) and 4.6.

(b) and up to 14 days prior to the relevant Course start date.

4.1.1 You will receive a full refund of your Fees less a € 100 charge to cover administration costs plus VAT where applicable. Where the cost of the Classroom Course and/or Online Courses is less than € 100, no refund will be payable by DT and no additional administration costs in excess of the Fees will be due to DT from you.

4.2 You must inform DT of your decision to cancel by e-mail;

4.3 If you cancel your purchase you must return any Study Materials you may have received from DT without undue delay and not later than 14 calendar days after you inform DT of the cancellation, in a reasonable and resalable condition.

4.4 If the value of the goods has been diminished by your handling, DT may recover the amount of this diminished value by deducting this amount from your refund.

4.5 Refunds will be made using the same method of payment as you used for the purchase and will be paid within 14 days of you informing DT of the cancellation (and having returned Study Materials to DT - if applicable).

4.6 Your right to cancel and obtain any refund will be lost if you have given DT express consent to supply any services during the Cancellation Period and the service has been fully performed. If express consent has been given but the service is only part performed, you will be liable to pay for the services actually received.

4.7 According to Clause 2.1.4.3 there is no any refund possible after you get a login password for our online materials.

4.8 Your order of a Course is personal to you and you will not be permitted to transfer your enrollment on a Course to any other student.

4.9 DT reserves the right to cancel / reschedule any Course because of low registration or events beyond DT’s control. In the unlikely event of cancellation, registrants will be notified and offered the option to switch to a Course on another date or receive a full refund. If DT cancels a Course, you will be entitled to a refund of any Fees paid in accordance with Clause 4.5.

4.10 Force majeur

DT will not be liable in cases where DT is unable to fulfill any services to which they are contractually bound because of fire, natural disaster, failure of public transport, strikes, official arrangements or other reasons which are beyond DT’s control.

4.11 Late arrivals, vacations and absences

If you begin your enrolment late or are absent during your course, no refund will be made for the time missed. Periods of absence cannot be made up with a free extension of the course.

4.12 Termination Policy – Cancellation after the Course has started

A course is a package with a fixed Tuition Fee for a number of hours that you accept on the moment of purchase. In case you terminate this course before it has been ended, you take voluntarily distance from this package, so the consumed hours of the package will be charged at the regular hour rate, with a maximum of the fixed price of the package. Students who terminate their program may not be eligible to receive a certificate.

 

5. Classroom Courses, One-on-One Courses and Online Courses

5.1 Please see the description of the Course on the Website and/or in the Brochure for details of the contents of the available Courses.

5.2 All Dutch classes are 50 minutes in duration unless otherwise stated. 50 minutes is considered as one hour.

5.3 Login with password

5.3.1 If you get a login with password to access the learning materials on our website, your login will expire after 30 days. This is applicable for Online Courses and some Classroom Courses.

5.3.2 Your login with password is personal. It is not allowed to share your login with password with other people. In case of abuse your login will be immediately deactivated without any notice and without any refund of the paid fees.

5.4 Except as set out in the description of the Course on the Website and/or in the Brochure, no additional Study Materials and/or tuition (either online, one-on-one or classroom) will be provided by DT.

5.5.1 You acknowledge that DT operates a zero tolerance policy in relation to inappropriate behaviour of students. In particular abusive or violent behaviour directed at DT’s staff or other students and unfair or dishonest practices including but not limited to cheating, will not be tolerated under any circumstances. DT may at its reasonable discretion and without liability or an obligation to refund Fees, refuse to supply any Classroom Course to any student and may remove any student whose participation in any Classroom Course would, in DT’s reasonable opinion, be undesirable or whose behaviour DT considers is or may be in breach of this Agreement.

5.5.2 If you fail to pay an amount you are directly or indirectly liable to pay DT, you (the student) may be expelled or suspended. No refund will be given.

5.6 In relation to Classroom only the following points apply:

5.6.1 You must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which Classroom Courses are provided.

5.6.2 You must sign an attendance register for each Classroom Course.

5.6.3 Your personal possessions are your sole responsibility and DT accepts no responsibility and/or liability for anything that is damaged, lost or stolen from its venues. You are advised during a Classroom Course to keep your valuables with you at all times.

5.6.4 Students must agree to abide by DT’s Student Code of Conduct and other policies while attending DT’s classes. Inappropriate conduct includes but is not limited to:

- disruptions to the learning environment, including the classroom and online (smoking, using drugs, harassment, etc.);

- deliberate destruction, misuse (e.g. standing instead of sitting on the toilet seat), or theft of DT property or the property of fellow classmates;

- violence or threats of violence towards persons or property of students or DT staff.

5.6.5 Mobile phones must be switched off during the lessons. Only during break times it is allowed to call or text, so that the full attention is with the lesson and other students will not be disturbed.

5.6.6 The room where the lessons are given should be kept tidy.

5.6.7 All students are expected to attend all of their classes. It is the responsibility of the student to inform the school of any absence. All lessons missed due to absence will be lost.

5.6.8 Students are encouraged to arrive for their lessons on time. Late arrival in the classroom is disruptive to the entire class.

5.7 Holidays

A Classroom Course might be once interrupted by a holiday. Students will be informed at the beginning of the course or at least 2 weeks before this holiday.

 

6. Warranties

6.1 DT will provide the Study Materials in accordance with the Course description which is set out on the website (please see Clause 5.1).

6.2 DT does not make any guarantee or commitment to you that the Study Materials will be error free.

6.3 DT guarantees the teacher’s mother tongue is Dutch. The teacher is a native Dutch speaker with a neutral accent which is understandable anywhere in the Netherlands and the Dutch part of Belgium.

6.4 Certificate of Completion

6.4.1 DT provides a Certificate of Completion only for regular students with less than 20 % of absences during the course.

6.4.2 The word “successfully” on the Certificate means you are allowed to follow a course on the next level and is a positive advice to take an exam (if applicable). If DT gives a negative advice, but you ignore it (e.g. you do take an exam), it is at your own risk.

6.4.3 A positive advice doesn’t guarantee the student to pass the exam in one take, since circumstances out of DT’s control may cause failure on the exam.

6.5 Last but not least: a successful learning process depends on the commitment of both the teacher and the student.

 

7. Extra Services

7.1 Airport Transfer Service

The student can make a reservation for an airport transfer within the enrolment form. This service includes being met at the airport by a school representative and transportation from the airport to the accommodation. The service of the representative to the enrolled student is free, but taxi costs (back and forth) are for your account. All flight information should be sent at least one week before arrival. This service is also available at additional cost for the return trip.

7.2 Assistance in finding a room

DT may assist you in suggesting and/or finding accommodation in the neighborhood of the school. This service is free for enrolled students. Since this is only a voluntary help, DT cannot be held responsible if the student is not satisfied with the accommodation.

 

8. General

8.1 This website contains material which is owned by or licensed to us. This material includes, but is not limited to, self-written texts, the design, layout, look, appearance and graphics. Reproduction is prohibited.

8.2 DT reserves the right to charge late payment interest on any overdue amounts, at a rate of 4% a year. The interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with the overdue amount.

8.3 These Terms and Conditions constitute the entire agreement and understanding between us.

8.4 If a situation arises that has not been covered by these Terms, we reserve the right to take any fair and reasonable action that we think appropriate.
